Ahmedabad, The Gujarat High Court will pronounce its verdict on Friday on Gandhi’s plea seeking a stay on the conviction of Congress leader Rahul Gandhi in a criminal defamation case over his remarks on the Modi surname. . According to the list released by the High Court on Thursday, the court of Justice Hemant Prachhak will pronounce the verdict at 11 am on Friday.
Staying the conviction would pave the way for Gandhi’s reinstatement as a member of Parliament. Justice Prachchak, while hearing Rahul Gandhi’s plea in May, refused to grant any interim relief and said he would pass the final order after the summer vacation. Rahul Gandhi’s lawyer had argued in the Gujarat High Court during a hearing on April 29 that the maximum sentence of two years for a bailable and non-cognizable offense meant his client could lose his Lok Sabha seat.
Surat’s Metropolitan Magistrate Court on March 23 convicted Rahul Gandhi under sections 499 and 500 (criminal defamation) of the Indian Penal Code (IPC) in a 2019 case filed by Bharatiya Janata Party (BJP) MLA Purnesh Modi in Gujarat. Was sentenced to two years in jail. Following the verdict, Gandhi was disqualified from membership of Parliament under the provisions of the Representation of the People Act. Rahul Gandhi was elected to the Lok Sabha in 2019 from Wayanad in Kerala.
