The US government has taken this step to prevent the abuse of its immigration system, with Secretary of State Marco Rubio having the authority to revoke visas when indications of potential ineligibility are found. This move follows an executive order issued by President Donald Trump on August 6, which defines birth tourism and authorizes the secretaries of state and homeland security to take action against individuals engaging in this practice. The order also allows for humanitarian and national-interest exemptions.
According to the State Department, some individuals and companies have turned birth tourism into a lucrative industry, advertising US birth services, visa coaching, and hospital arrangements. They often use deceptive tactics, such as forging medical documents or coaching clients to hide their true purpose of travel. The department has cited several cases where individuals have lied about their purpose of travel or concealed information to obtain a visa. With the 14th Amendment to the US Constitution providing the basis for birthright citizenship, the US government is taking steps to prevent the exploitation of this provision.
