New Delhi. The Supreme Court will hear on October 10 the final hearing on the appeals filed against the decision of the Appellate Tribunal in the Android app case of giant technology company Google. A bench of Chief Justice DY Chandrachud, Justice PS Narasimha and Justice Manoj Mishra on Friday said on the appeals filed by Google and the Competition Commission of India (CCI) in this case that it wanted some time to look into the aspects related to the matter. Is. To this, senior advocate Harish Salve, appearing for one of the parties, said that the petition can be put up for final disposal later.
The court then said that both the appeals may be listed for final disposal on October 10 and the concerned parties should file their arguments by October 7. Along with this, the court also appointed advocate Sameer Bansal as nodal counsel for preparing a common digital argument with the help of lawyers from both the sides.
On March 29, the National Company Law Appellate Tribunal (NCLAT) had given a verdict on the alleged anti-competitive practices of Google in this case. In that, the tribunal upheld the fine of Rs 1,338 crore imposed on Google but removed conditions like approving other app stores on its Playstore.
The penalty was imposed by the CCI on Google for misusing its dominant position in the Android mobile ecosystem. Apart from this, the Competition Commission had said that Google will not prohibit the removal of pre-installed apps on mobile by users.
Against that order of NCLAT, both Google and CCI have appealed in the Supreme Court. On October 20 last year, the CCI had imposed a fine of Rs 1,337.76 crore on Google for adopting anti-competitive practices with respect to Android mobile devices. This decision was challenged before the NCLAT from where it got partial relief. (agency)
