On Wednesday, the Delhi High Court ruled in favor of Khushi Kapoor, ordering the removal of allegedly obscene content from social media sites that used her identity without permission. The court also directed the removal of content related to the unauthorized sale of items that exploited her personality traits. Justice Jyoti Singh issued the orders while hearing Kapoor’s claim for the protection of her personality and publicity rights.
The court suggested issuing a John Doe order in Kapoor’s favor, which would protect her against anonymous individuals who may be using or exploiting her identity without her permission. India Law, represented by partners Asav Rajan and Abha Shah, argued on behalf of Kapoor. This ruling came a day after a similar order was issued for the removal of allegedly offensive content and unauthorized use of Kapoor’s sister, Janhvi Kapoor’s, personality rights.
The Delhi High Court has seen an increase in cases involving the unauthorized use of celebrities’ names, photos, voices, and likenesses in recent years. These cases often involve the use of digital content, AI-generated content, and commercial items that exploit the identities of prominent individuals. The court has deemed a person’s name, image, and likeness to be factors that can be legally protected against unauthorized use, particularly when such use jeopardizes financial interests, reputation, or dignity.
