Modi surname issue: The Supreme Court will hear the petition of Rahul Gandhi on July 21
New Delhi, July 18 (Agency) The Supreme Court on Tuesday agreed to hear on Friday (July 21) the petition filed by Congress leader Rahul Gandhi in the case of comment on Modi’s surname. Through this petition, Rahul Gandhi has challenged the Gujarat High Court’s decision in which the Sessions Court refused to convict him and stay the sentence in the Modi surname case. Rahul Gandhi was sentenced to 2 years in the case, after which he was disqualified from Parliament.
Senior advocate Abhishek Manu Singhvi, referring to Gandhi’s plea before Chief Justice of India DY Chandrachud, requested immediate listing. The CJI agreed to make the list on Friday. Gandhi has filed a special leave petition challenging the Gujarat High Court’s refusal to stay his conviction in the criminal defamation case.
It may be noted that on July 7, the Gujarat High Court refused to suspend the sentence awarded to Congress leader Rahul Gandhi in the defamation case. The court had said that there were 10 criminal cases pending against the Congress leader and there was nothing wrong with the lower court’s decision.
The Gujarat High Court in its judgment said that the decision of the trial court was correct and legal, there is no need to interfere with this order. Therefore, the application for suspension of sentence in the defamation case of Rahul Gandhi is dismissed.
In its order, the court told Rahul Gandhi that several criminal cases are pending against him. Even after this current case, there are several cases against you, one such case has been filed by Veer Savarkar’s grandson. In such a situation, your punishment is not a matter of injustice. Your conviction is correct and we will not interfere with the order of the lower court.
A Surat court had on April 20 rejected Rahul Gandhi’s plea to suspend the 2-year sentence handed down by a magistrate court. Rahul Gandhi had approached the Gujarat High Court against it. After the court’s decision, Rahul Gandhi has lost the membership of the Parliament from Wayanad in Kerala. Former BJP MLA Parneesh Modi had filed a case against Rahul.
