A wife who is able to work cannot ask for maintenance; Karnataka High Court

Bangalore, July 06; The Karnataka High Court has given an important verdict that a wife who is capable of working cannot ask for more maintenance from her husband. Also, on the same basis, the monthly 10 thousand rupees announced by the magistrate court to the wife in a family litigation. Alimony and 3 lakhs of Rs. 5 thousand respectively as compensation. And reduced to Rs. 2 lakh.

This order was passed by a bench headed by Justice Rajendra Badamikar, who had dismissed the criminal review petition filed by the woman and her minor son of Anekal challenging the order of the 66th Additional Civil and Sessions Court of Bangalore.

What is the High Court order?; From the records it is known that the applicant woman was working before marriage. After separating from her husband, the wife, who lived with her mother and son in a rented house, refused to live with her husband’s mother and sisters.

The husband who runs a grocery store has to take care of his mother and unmarried sister. Why is the wife who quit her job after marriage, not able to work now? The High Court said that no explanation has been given.

An able-bodied wife should not sit idly by without a job and demand full maintenance from her husband. The responsibility of trying to maintain life will be on her, and she can only ask for supplementary maintenance from her husband. In this background, the High Court dismissed the petition of the wife in the order issued by the trial court reducing the amount of alimony and compensation

Background of the case: The wife, who filed an application in the Bangalore Magistrate’s Court under the Protection of Women from Domestic Violence Act-2005, sought alimony and compensation from her husband. The husband also attended the hearing of that application. The court which conducted the inquiry ordered the wife to pay Rs 10,000 per month. 5 thousand per month for a minor son. The husband was ordered to pay maintenance. In addition, Rs 3 lakh as compensation for the mental torture he suffered. It was also ordered to give compensation.

Challenging this order, the husband filed an appeal before the City Civil and Sessions Court in 2014. The court that heard the appeal, 10 thousand rupees announced to the wife. Apart from reducing the alimony to Rs 5 thousand, the compensation amount was increased from Rs 3 lakh to Rs 2 lakh. It was reduced to s. The wife and son filed a review petition in the High Court seeking cancellation of this order.
